GENERAL TERMS AND CONDITIONS OF SALE (GTC)

1. Preamble
1.1 These General Terms and Conditions of Sale (hereinafter “GTC”) govern the sale of
clothing, footwear, and accessory products (hereinafter “Products”) through the website
www.romolinifirenze.com (hereinafter “Website”).
1.2 The Website is managed by Gr Group srl, with registered office at Via Ricasoli 9 – 50122 Florence, VAT/Tax ID

(hereinafter “Seller”).
1.3 The GTC apply to all orders placed by consumers as defined by Legislative Decree 206/2005
(Consumer Code).
2. Subject of the contract
2.1 This contract governs the remote purchase of Products available on the Website, via electronic means.
2.2 The essential characteristics of the Products are described in each product sheet. The
images are indicative and may not faithfully reflect the actual color or details due to the settings of the device used.
3. Acceptance of the GTC
3.1 By placing an order on the Website, the customer declares to have read, understood, and accepted these
General Terms and Conditions of Sale and the Privacy Policy.
3.2 The GTC can be consulted at any time through the dedicated section of the Website and can be
saved or printed.
4. Registration and user responsibility
4.1 Account creation may be required to place an order.
4.2 The Customer guarantees the truthfulness of the data provided and undertakes to keep their
access credentials confidential.
4.3 The Seller is not responsible for fraudulent use of the account by third parties.
5. Products and availability
5.1 The essential characteristics of the Products are presented on the Website within each product sheet,
accompanied by faithful descriptions and images. However, colors may differ
slightly due to the settings of the device used.
5.2 The availability indicated on the Website is purely for information and non-binding.
5.3 In case of unavailability after the order, the Seller will inform the Customer within 5 business days
and will proceed with a refund or replacement.
6. Prices and invoicing
6.1 Product prices are expressed in euros and include applicable VAT.
6.2 Shipping costs are indicated during the purchase procedure, calculated and included in the
order confirmation.
6.3 The Seller may change prices at any time, but Products will be invoiced at the price in effect at the time of the order.
6.4 The invoice, if requested, will be sent in electronic format via e-mail or the Sdi system.
7. Orders and conclusion of the contract
7.1 Orders can be placed on the Website 24 hours a day, 7 days a week.
7.2 An order constitutes a purchase proposal. The contract is considered concluded when the Customer
receives an order confirmation email from the Seller.
7.3 The Seller reserves the right to refuse orders that are:
suspicious, incomplete, or containing untrue data;
from Customers with pending disputes;
exceeding quantities intended for personal use.
8. Payment methods
8.1 The following payment methods are accepted:
Credit/debit cards (Visa, Mastercard, American Express, etc.);
PayPal;
Bank transfer;
Installment payment systems (e.g., Klarna) if available.
8.2 Payment is considered successful only after the actual crediting of the amounts due.
8.3 Payment data is not managed or stored by the Seller but exclusively by
certified payment providers.
8.4. Payment data will never be reused except to issue relevant refunds in case of any returns.
9. Shipping and delivery
9.1 Products will be delivered to the address indicated by the Customer during the purchase proposal phase.
9.2 All orders are processed by the date indicated in the Order Confirmation communication and, in any case, within a maximum period of 30 days from the Order Confirmation date.
Orders placed during the weekend (Saturday and Sunday) or public holidays are processed starting from the next working day.
9.3 In case the Seller is unable to meet the above deadline, for any reason whatsoever, and in any case subject to force majeure, unforeseeable circumstances or facts not attributable to the Seller, the Seller will promptly send an email to the Customer informing them of the new shipping deadline. In this case, the customer will have the right, within 5 working days, to cancel the order and obtain a full refund of the price.
9.4 Shipping costs in Italy are borne by the Customer for amounts up to €129.99; shipping will be free and borne by the Seller for amounts from €130.00.
9.5 Shipping costs for Europe and outside Europe are borne by the Customer and are automatically calculated at checkout based on the destination country.
9.6 Delivery times are purely indicative and subject to carrier availability:
Italy: 1 – 3 working days
Europe: 4 – 6 working days (variable due to customs and destination)
Outside Europe: 6 – 15 working days (variable due to customs and destination)
9.7 We rely on certified express couriers, selected to ensure punctuality and security. Tracking information is sent via email as soon as the order has been shipped.
9.8. If the recipient is not present at the time of delivery, the courier will leave a notice and attempt delivery the following day. Couriers only transport and deliver products on working days.
9.9 Any delays not attributable to the Seller (strikes, weather conditions, customs, etc.) do not constitute grounds for compensation.
9.10 The risk of loss and/or damage is transferred to the Customer upon delivery to the latter, and it is, in any case, the Customer's responsibility to carry out the necessary checks on the condition and conformity of the goods delivered compared to the order placed, without prejudice to the Seller's responsibility for missing or defective products at origin.
9.11 The delivery times indicated above refer exclusively to products in stock at the time of the purchase order.
10. Right of withdrawal (Arts. 52–59 Consumer Code)
10.1 The Customer may exercise the right of withdrawal within 14 days of receiving the Product, without
obligation to provide a reason.
10.2 To exercise the right of withdrawal, the Customer must send an explicit statement via email to
info@romolinifirenze.com.
10.3 Products must be returned within 14 days of sending the communication exercising the right of withdrawal and must be:
intact,
unused,
unwashed,
with original labels and/or packaging.
10.4 The following are excluded from withdrawal, pursuant to Art. 59 of the Consumer Code:
custom-made or personalized goods;
sealed goods that cannot be returned for hygiene reasons once opened.
10.5 By law, return shipping costs are borne by the Customer. Shipping, until certified receipt at our warehouse, is under the full responsibility of the customer. In case of damage to the goods during transport, the Seller will notify the Customer of the incident (within 5 working days of receiving the goods at its warehouses), to allow the Customer to promptly file a claim against the courier chosen by them and obtain a refund of the value of the goods (if insured). The Seller is in no way responsible for damage or theft/loss of returned goods.
10.6 The Seller will refund the amount within 14 days of receiving the returned Products, provided that all provisions of point 10.3 have been fully complied with.
10.7 In the event of forfeiture of the right of withdrawal or return of products that are not intact, used, washed, and/or without original labels and/or packaging, which will be duly photographed and/or filmed at the time of their receipt by the seller, the latter will return the purchased goods to the sender, charging the shipping costs to the sender.
11. Product Returns and Refunds
11.1 Returns, outside of the cases provided for by the right of withdrawal in Article 10 above, must take place no later than 14 days from receipt of the product, with the returned goods arriving at our warehouse no later than 14 subsequent days.
11.2 The product must be intact, must not have been used, and/or washed, and must be returned in its original packaging including the original label/tag.

11.4 The Seller, after receiving the product and verifying its integrity, will refund only the price of the product to the customer.
11.5 If the Customer has used the Klarna payment method, a return is not possible, only an exchange.
11.6 If the Customer has purchased a made-to-order, custom-made, or personalized product, neither a return nor an exchange is possible.
11.7 Exchanges are not returnable.
11.8 The Seller is not responsible for refunds relating to Products shipped but not received by the Seller due to loss, theft, damage, or other causes not attributable to the Seller itself.
11.9 All products purchased from the Website at a discount through sales or discount codes are not returnable, but can only be exchanged for other goods for sale on the site. In such cases, a refund is therefore excluded, but an exchange is only granted according to the procedures in point 12.
11.10 Return shipping costs are borne by the Customer.
12. Exchange
12.1 To exchange a Product, you must send an email to
info@romolinifirenze.com or fill out the form on the dedicated page, communicating the decision to
exercise the right of exchange within 14 days of receiving the Product, with the return of the goods to our warehouse within the same timeframe.
12.2 The product must be intact, must not have been used and/or washed, and must be returned in its original packaging including the original label/tag.

12.4 Once the package has been received, the Seller will assess the condition of the Product sent and will proceed with the exchange by shipping it, charging the costs to the customer.
12.5 If the Customer has purchased a made-to-order, custom-made, or personalized product, neither a return nor an exchange is possible.
12.6 The Seller is not responsible for refunds relating to Products shipped but not received by the Seller due to loss, theft, damage, or other causes not attributable to the Seller itself.
12.7 Return shipping costs are borne by the customer.
13. Defects, non-conformity and legal warranty
13.1 Products are covered by the legal warranty of conformity provided by the Consumer Code
(Legislative Decree 206/2005).
13.2 In case of a defective Product or one not conforming to the description, the Customer may request
repair, replacement, price reduction, or refund.
13.3 The defect must be reported by the Customer within 2 months of discovery, by sending an email to
info@romolinifirenze.com, indicating the Customer's personal data, order number, indication of the
defect and/or non-conformity found, all accompanied by at least one photograph of the product that
demonstrates the defect and/or non-conformity found.
13.4 The Seller reserves the right to verify the actual existence of the defect and/or non-conformity
upon physical receipt of the product.
13.5 In the absence of discrepancies and/or defects in the product purchased by the Customer, all costs for the new shipment will be borne by the Customer.
13.6 The legal guarantee is excluded if the Customer has damaged the products through their own wilful and/or negligent conduct, or, in any case, if due to their negligence and/or carelessness and/or for other reasons not attributable to the Seller, they have damaged and/or rendered the products defective, and/or exposed them to natural events and/or used them improperly and/or without following the technical instructions indicated on the site or on the labels, and/or have carried out or had repairs, interventions or tampering carried out by personnel not authorized by the Seller, and/or have omitted the necessary maintenance, and/or have stored them incorrectly. The guarantee is also excluded if the defects and/or flaws and/or malfunctions derive from a use of the products different from that for which they were designed and manufactured, or in the case of normal wear and tear or deterioration of consumable parts.
13.7 Should the Seller find that any flaws and/or defects in one or more products sent to the Customer are attributable to the Customer, directly or indirectly, the Customer will be required to pay the
verification costs incurred by the Seller, as well as the actual expenses for their return and, if applicable, for repair.
14. Limitation of Liability
14.1 The Seller is not responsible for:
improper use of Products;
Website interruptions;
indirect or consequential damages;
violations by payment providers.
14.2 In no event shall the Seller's total liability exceed the value of the
Product purchased.
15. Privacy and processing of personal data
15.1 For the execution of the contract, the Customer is obliged to provide certain personal data. The Customer declares and guarantees that the data provided to the Manager during the purchase and/or registration process is correct and truthful. Partial or unexpected failure to provide Customer data to the Manager may result in the impossibility of executing the contract.
15.2 The Customer's personal data is processed in accordance with the GDPR (EU Reg. 2016/679) and
Legislative Decree 196/2003 as amended.

16. Intellectual Property
16.1 All content on the Website (texts, photos, trademarks, logos, graphics, software) are the property of the Seller and protected by copyright.
16.2 Total or partial reproduction without authorization is prohibited.
17. Force Majeure
17.1 The Seller is not responsible for non-performance of the contract caused by unforeseen events or force majeure (e.g., natural disasters, pandemics, network failures, strikes, and more generally acts of God).
18. Changes to the GTC
18.1 The Seller may update the GTC at any time.
18.2 The new conditions will be valid from the date of publication on the Website.
19. Applicable Law and Competent Court
19.1 The contract is governed by Italian law.
19.2 For consumers, the competent court is the place of residence or domicile of the Customer (Art. 66-bis Consumer Code).
19.3 For non-consumer Customers, the exclusive competent court is Florence.
